Roundtable meeting was held on the topic of appraisal activities and legislation on forensic activities in the field of appraisal

On December 9 this year, the State Assets Management Agency together with the Ministry of Justice held a roundtable meeting on "Legislation on valuation activities and forensic appraisal activities and its correct enforcement in practice" with the participation of concerned ministries and bodies.

The event was attended by representatives (over 200 people in total) of the Supreme Court, General Prosecutor's Office, State Security Service of the President, State Security Service, Ministry of Internal Affairs, National Guard, Ministry of Economic Development and poverty reduction, Ministry of Construction, State Tax Committee, State Customs Committee, Cadastral Agency, Chamber of Lawyers, Association of Appraisers, Society of Appraisers of Uzbekistan, The Republican Center of Forensic Expertise named after Kh. Sulaimonova and their territorial structures.

During the event it was noted that the country focuses on further development of market economy principles, formation and ensuring the inviolability of private property, determination of the real market value of property, as well as improving the effectiveness of forensic expertise in the field of appraisal activities.

At the event, the following issues were discussed, in particular:

  • In determining the market value of property, appraisers carry out their activities on the basis of the Law "On Appraisal Activities", the Unified National Appraisal Standard and upon its completion make an appraisal report. And forensic experts of the Republican Center of Forensic Expertise named after Kh. Sulaimonova carry out their activities on the basis of the "Criminal Procedure Code" of the Republic of Uzbekistan, the Law of the Republic of Uzbekistan "On Forensic Expertise", based on the appraisal methods of the center and upon the end they prepare a document as a "conclusion of state forensic examination" or "expert opinion", different from the appraisal report. This leads to the creation of differing reports (summaries) to determine the real market value of property, and their results lead to disputable situations in practice. Based on this and given the international best practices, it was decided to ensure the application of unified and consolidated appraisal standards in practice, including in the judicial system;
  • in connection with providing professional public associations of appraisal organizations with additional authorities for regulation of appraisal activities, in order to implement self-governing mechanisms and further quality enhancement of appraisal and expertise of appraisal reports it was decided to revise the work of the Expert Commission for expertise of appraisal materials in disputable situations, established by the Decision of the Cabinet of Ministers dated July 28, 2008 No. 161 as well as to amend and supplement the existing legislation;
  • in order to provide proper execution of appraisal reports by the court and law enforcement agencies in determining the market value of property, to further improve the knowledge and skills of professionals in the field of appraisal, it was determined the necessity of regularly holding such roundtables, workshops and seminars;
  • in order to improve the professional and legal knowledge of court experts and appraisers, it was decided to optimize the training programs for appraisers and court experts.

As a result of the round table were identified appropriate further measures for joint implementation to eliminate the problems encountered in this area and the development of this sector.
